Terms of Service for Bystander Video Blur

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Bystander Video Blur mobile application (the "Service") operated by AMBERMASTIFF ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Use of the Service

1.1 License

Subject to these Terms, AMBERMASTIFF grants you a personal, non-transferable, non-exclusive, revocable, limited license to use the Service on an iOS device owned or controlled by you.

1.2 Local Processing

You acknowledge that the Service processes video and image content locally on your device. You retain full ownership and responsibility for the content you process using the Service. We do not upload, store, or monitor your video content on our servers.

1.3 Age Restrictions

The Service is intended for users who meet the minimum age requirement specified in the App Store rating for this application. By using the Service, you represent and warrant that you meet this requirement.

1.4 Codecs

The Service utilizes standard operating system codecs. Your use of such codecs is subject to Apple's terms and conditions.

2. Prohibited Uses

You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation (including, but not limited to, the laws of Japan).
  • To infringe upon the rights of others, including but not limited to privacy rights, portrait rights, and intellectual property rights (e.g., copyright, trademark).
  • To create, edit, or share content that is:
    • Defamatory: Content that damages the reputation, honor, or social standing of any individual or entity.
    • Privacy-Violating: Content that reveals private information or depicts individuals without their consent (including "revenge porn" or non-consensual intimate imagery).
    • Illegal: Content that promotes or depicts illegal acts.
    • Harmful or Abusive: Content that is threatening, harassing, abusive, or promotes hate speech, discrimination, or violence.
    • Obscene: Content that violates obscenity laws or community standards.
  • To attempt to reverse engineer, decompile, or disassemble any portion of the Service.
  • To transmit any viruses, malware, or other malicious code.

You are solely responsible for ensuring that your use of the Service and any content you create complies with all applicable laws and regulations in your jurisdiction and the jurisdiction where the content may be shared.

3. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of AMBERMASTIFF and its licensors. The Service is protected by copyright, trademark, and other laws of both Japan and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AMBERMASTIFF.

4. Third-Party Services

The Service may contain links to third-party web sites or services that are not owned or controlled by AMBERMASTIFF (e.g., Google AdMob).

AMBERMASTIFF has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that AMBERMASTIFF shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

5. Disclaimer of Warranty

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

AMBERMASTIFF does not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Specific Disclaimer Regarding Face Detection: You expressly acknowledge and agree that the face detection and blurring technology used in the Service may not be 100% accurate or effective in all situations. AMBERMASTIFF does not guarantee that all faces or sensitive information will be successfully detected or obscured. It is your sole responsibility to review the final output video to ensure that all desired faces or information are adequately blurred or masked before sharing, publishing, or otherwise using the video. AMBERMASTIFF shall not be liable for any failure of the Service to detect or blur any specific face or object.

6. Limitation of Liability

In no event shall AMBERMASTIFF, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

7. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the Fukuoka District Court.

8. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
